Please read these Terms and Conditions carefully before using the services offered by PINDAHMAN Mobile Application Platform, a subsidiary of Brilliant Richwell Sdn Bhd (PINDAHMAN) or (“We”, “Us” or “OUR”), a company incorporated under Malaysia’s law. These terms are set forth the legally binding terms and conditions for your use of Our Services as contained in https://www.Pindahman.com (“Website”) (collectively with the site, referred to as “Services”).
1. RETURN OF YOUR ITEMS
PINDAHMAN do not accept any return of your items / orders and we do not replace any of your items. We will endeavor all reasonable care to ensure that Our Services conform with the standard delivery care of any delivery services in Malaysia.
2. REFUND OF YOUR PURCHASE
A “Cancellation Fee” which is 50% of the agreed order fee for the transaction will be applicable in the following circumstances:
If User has make cancellation in PINDAHMAN application for the delivery request after 5 minutes (for Immediate Order) or 30 minutes (for Scheduled Order), or
If User no show at the Pick-Up location after our Driver Partner has arrive at the location.
For clarification, if the User has cancel the transaction / order within 5 minutes (for Immediate Order) or 30 minutes (for Scheduled Order), no cancellation fee will be applicable.
However, if the transaction / order / service was paid but not fulfilled due to factors beyond PINDAHMAN’s control, we will offer an alternative or you will be entitled to a full refund of amount paid for the specific transaction / order / service.
We will refund the amount and a credit will be applied to the original method of payment that you use to make payment to our Service or any such manner as may be communicated to you.
3. DAMAGED GOODS
At all times, it remains the responsibility of the User / sender to ensure the item is adequately and properly packed.
For fragile item or items that withstand the risk of damage, items that are easily deteriorate during transportation; loading and unloading, User / sender ensure that the item is adequately and properly packed and marked “fragile” or “valuable”. PINDAHMAN will not be liable for any loss or damages to these items arising from the result of your failure to perform such obligations.
PINDAHMAN will not be liable for any damages, loss or deterioration of items unless there was negligence / recklessness of the Driver Partner. Notice of damage must be given to us within 1 hour after delivery/job completed by contacting our Customer Service. It is compulsory to send the photographic evidence of the damage, invoice of the item purchased (if any) and email to our Customer Service. The maximum compensation that can be granted is capped at RM200 across all items transported or whichever is lower.
Our Customer Service will examine the claim, we shall examine any defects of the item prior to the loading of your items for transportation, hence we will not be liable for any unnoticed defect that is not informed by you.
4. DELIVERY OF GOODS
User can trace the location of Driver Partner in PINDAHMAN platform, upon our Driver Partner is on the way to collect your item until the item is delivered.
When User make a booking with us via PINDAHMAN platform, please ensure that you have ordered the correct and most suitable vehicle size, for any excess cargo will be subject to additional charges.
Please state clearly the type of property (landed or non-landed) and levels of your property. The manpower required must order accurately, for over-sized items must be carried by appropriate number of manpower. Last minute changes will subject to additional charges.
5. NO WAIVER
The failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies.
6. GOVERNING LAW
These Terms and Conditions shall be governed and interpreted in accordance with the law of Malaysia and the parties irrevocably submit to the exclusive jurisdiction of the Malaysian courts.
7. SPECIAL TERMS
These Terms and Conditions are not intended to create any rights, claims, entitlements or benefits enforceable by any person that is not a party to them. No person shall derive any benefit, or any rights, entitlement or claim in relation to this Terms and Conditions.
8. CHANGES TO THE TERMS AND CONDITIONS
PINDAHMAN reserves the right to update these Terms and Conditions from time to time and any changes may be made without providing notice to you. The updated versions will be posted on our PINDAHMAN platform and website. We recommend you check back our Terms and Conditions from time to time to check any updates or changes. Continuation of the use of PINDAHMAN service without notifying us on any issues, we will deem that you have agreed with our latest Terms and Conditions.
